1. Agreement to Terms

These Terms & Conditions ("Terms") govern your use of the Mesikas Hatorah website and your participation in the Mesikas Hatorah membership program (the "Program"), operated by Mesikus Hatorah, a DBA of Ohel Faiga Inc. ("we," "us," or "our"). By using this website or enrolling as a member, you agree to these Terms. If you do not agree, please do not use the website or enroll.

2. The Program

Mesikas Hatorah is a Torah review program. Members record a personal learning portfolio (the אוצר חזרה תמידית) with our staff, and receive structured daily review assignments generated from that portfolio. All member records — portfolio contents, daily assignments, completion status, and billing state — are managed by our internal staff on the member's behalf. The Program does not currently include a member-facing online account.

3. Membership and Enrollment

• Enrollment is completed through our office by phone, email, or in person.
• You agree to provide accurate and current information, including your contact details and learning portfolio.
• We may accept or decline any enrollment at our discretion.

4. Subscriptions, Trials, and Payment

• Membership is provided on a subscription basis. Current pricing, billing intervals, and any trial period are communicated by our office at enrollment.
• Payments are processed by a third-party payment processor using secure, tokenized card-on-file billing. We never store your full card number.
• Where automatic billing is enabled, you authorize us to charge your saved payment method at the agreed interval until you cancel.
• If a payment fails, we may retry the charge and will contact you to update your payment details. Continued non-payment may result in suspension of membership.

5. Cancellation and Refunds

• You may cancel your membership at any time by contacting our office.
• Cancellation stops future billing. Unless otherwise stated by our office, fees already paid for the current billing period are not refunded.
• We may modify pricing with reasonable advance notice; changes take effect at your next billing cycle.

6. Member Responsibilities

• Keep your contact and payment information up to date.
• Report daily review completion honestly; the Program's value depends on accurate records.
• Use the website and Program only for lawful, personal, non-commercial purposes.

7. Text Messaging (SMS) Program

Mesikas Hatorah offers an optional SMS text messaging service for members and individuals who have opted in. By opting in, you agree to the following:

• Program description: You will receive recurring text messages from Mesikas Hatorah, which may include daily review reminders, membership and account notifications, billing and payment reminders, and replies to your inquiries.
• Consent: Consent to receive text messages is not a condition of membership or of any purchase. You may participate fully in the Program without opting in to SMS.
• Message frequency: Message frequency varies based on your account activity and review schedule.
• Cost: Message and data rates may apply according to your mobile carrier plan.
• Opt-out: You can cancel the SMS service at any time by replying STOP to any message. After you send STOP, we will send a final message confirming that you have been unsubscribed, and you will receive no further messages. To rejoin, contact our office and opt in again.
• Help: Reply HELP to any message, or contact us at [email protected] for assistance.
• Carriers: Mobile carriers are not liable for delayed or undelivered messages.
• Privacy: Mobile information and text messaging opt-in data will not be shared with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy for details on how your information is handled.

8. Intellectual Property

The Mesikas Hatorah name, logo, website content, and the Program's schedules, materials, and methodology are the property of Ohel Faiga Inc. You may not reproduce, distribute, or create derivative works from them without our prior written permission, except for personal, non-commercial use as a member.

9. Disclaimers

The website and Program are provided "as is" and "as available." While we work hard to keep schedules and Torah metadata accurate, we do not guarantee that the website or Program will be error-free or uninterrupted. Daily assignment calculations are an organizational aid; halachic questions should be directed to your own Rav.

10. Limitation of Liability

To the fullest extent permitted by law, Ohel Faiga Inc., Mesikus Hatorah, and their staff shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the website or participation in the Program. Our total liability for any claim shall not exceed the membership fees you paid in the twelve months preceding the claim.

11. Privacy

Your use of the website and Program is also governed by our Privacy Policy, which describes how we collect and handle your information.

12. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date above reflects the most recent revision. Continued membership after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Any dispute shall be resolved in the courts located in Kings County, New York, unless the parties agree to resolve it before a mutually acceptable Beis Din.
